WHAT DOES COMPULSORY EXPROPRIATION MEAN

Αναγκαστική απαλλοτρίωση είναι η νομική διαδικασία στέρησης της ιδιωτικής περιουσίας για λόγους δημόσιας ωφέλειας .

Compulsory Expropriation is the legal process of taking the private property by the state , for the interest of the public .

ΠΡΟΥΠΟΘΕΣΕΙΣ ΑΝΑΓΚΑΣΤΙΚΗΣ ΑΠΑΛΛΟΤΡΙΩΣΗΣ

COMPULSORY EXPROPRIATION PREREQUISITES

Οι βασικότερες προϋποθέσεις :

The basic prerequisites for an expropriation to take place are :

Διατάξεις Νόμου για την κατασκευή συγκεκριμένου έργου που επιτρέπουν την κατάληψη ιδιωτικής περιουσίας με τη διαδικασία της απαλλοτρίωσης .

Law Provisions determining the construction of a specific project and allowing the seizure of private property via the expropriation process .

Επιμελής αποτύπωση και περιγραφή των προς απαλλοτρίωση ακινήτων σε κτηματολογικό πίνακα και διάγραμμα με εξαίρεση δημόσιων και δασικών εκτάσεων .

Thorough land surveying and description of the properties to be expropriated in a cadastral table and diagram except for the public and forest areas .

Εγγραφή του συνολικού ποσού της εκτίμησης σε συγκεκριμένο κωδικό του προϋπολογισμού .

The fee of the expert appointed is similar as if , participating in Public Committees .

Το δικαστήριο , για να καθορίσει την αποζημίωση , λαμβάνει υπόψη την εκτίμηση του άρθρου 15 ή αυτή των Πιστοποιημένων Εκτιμητών οι οποίες επικαιροποιούνται μετά τη δημοσίευση της απόφασης της απαλλοτρίωσης , χωρίς αυτές να είναι δεσμευτικές στην απόφασή του .

The court , in order to determine the compensation , takes into account the assessment of Article 15 or that of Certified Appraisers which will be updated after the publication of the decision of expropriation , without being binding in its judgment .

Σε κάθε περίπτωση όμως , όταν υπάρχει μεγάλη απόκλιση απαιτείται αιτιολόγηση .

In any case , when there is a large margin , justification is required .
