(trg)="16"> DUTIES , OBLIGATIONS AND OTHER ISSUES PERTAINING TO THE POSITION OF THE PRESIDENT OF EL.STAT. :

(src)="17"> i ) Ο Πρόεδρος της ΕΛ.ΣΤΑΤ. είναι το ανώτατο όργανο της ΕΛ.ΣΤΑΤ , ασκεί όλες τις αρμοδιότητές της και έχει την ευθύνη της εύρυθμης λειτουργίας της για την εκπλήρωση των σκοπών της σύμφωνα με τις διατάξεις της εθνικής και ευρωπαϊκής νομοθεσίας , του Κώδικα Ορθής Πρακτικής για τις ευρωπαϊκές στατιστικές και των βέλτιστων διεθνών στατιστικών πρακτικών .
(trg)="17"> i ) The President of EL.STAT. is the supreme officer of EL.STAT. , and shall exercise all its powers and shall be responsible for ensuring that the authority operates without problems in order to discharge its objectives in line with the provisions of national and European law , the European Statistics Code of Practice and best international statistical practices .

(src)="18"> ii ) Ο Πρόεδρος της ΕΛ.ΣΤΑΤ. έχει ιδίως τις ακόλουθες αρμοδιότητες :
(trg)="18"> ii ) More specifically , the President shall have the following competences :

(src)="19"> α ) εγκρίνει το Ελληνικό Στατιστικό Πρόγραμμα ( ΕΛ.Σ.Π. ) ,
(trg)="19"> a ) he shall approve the Hellenic Statistical Programme ( EL.S.P. ) ;

(src)="20"> β ) καταρτίζει τον Κανονισμό Στατιστικών Υποχρεώσεων των φορέων του Ελληνικού Στατιστικού Συστήματος ( ΕΛ.Σ.Σ. ) και τον Κανονισμό Λειτουργίας και Διαχείρισης της ΕΛ.ΣΤΑΤ ,
(trg)="20"> b ) he shall prepare the Regulation on Statistical Obligations of the agencies of the Hellenic Statistical System ( EL.S.S. ) and the Regulation on the Operation and Administration of EL.STAT. ;

(src)="21"> γ ) καταρτίζει το ετήσιο στατιστικό πρόγραμμα εργασίας της ΕΛ.ΣΤΑΤ. και την έκθεση αξιολόγησης του στατιστικού προγράμματος του προηγούμενου έτους ,
(trg)="21"> c ) he shall prepare the annual statistical work programme of EL.STAT. and the evaluation report of the statistical programme of the previous year ;

(src)="22"> δ ) αποφασίζει την επιβολή διοικητικών κυρώσεων , σύμφωνα με τα άρθρα 9 και 12 του ν . 3832 / 2010 , όπως ισχύει ,
(trg)="22"> d ) he shall decide on the imposition of administrative sanctions , in accordance with articles 9 and 12 of the Law 3832 / 2010 , as in force ;

(src)="23"> ε ) λαμβάνει τις αποφάσεις σχετικά με τις στατιστικές μεθόδους , τα πρότυπα και τις διαδικασίες , καθώς και με το περιεχόμενο και τη χρονική στιγμή της δημοσίευσης στατιστικών στοιχείων , σχετικά με τη διαβίβαση των επίσημων στατιστικών του ΕΛ.Σ.Σ. στην Ευρωπαϊκή Στατιστική Υπηρεσία ( Eurostat ) και γενικότερα σχετικά με τη διαβίβαση , υποβολή ή γνωστοποίηση στατιστικών στο πλαίσιο της ευρωπαϊκής και διεθνούς στατιστικής συνεργασίας ,
(trg)="23"> e ) he shall take decisions relating to statistical methods , standards and procedures , the content of statistical data and the timing of publication thereof , decisions relating to the transmission of official statistics from the Hellenic Statistical System ( EL.S.S. ) to the European Statistical Office ( Eurostat ) and in general decisions relating to the transmission , submission and notification of statistics in the context of European and international statistical cooperation ;

(src)="24"> στ ) είναι αρμόδιος για το συντονισμό όλων των δραστηριοτήτων των λοιπών φορέων του ΕΛ.Σ.Σ. που αφορούν την ανάπτυξη , την παραγωγή και τη διάδοση των επίσημων στατιστικών της χώρας , καθώς και για την εφαρμογή του εθνικού πλαισίου διασφάλισης ποιότητας των στατιστικών ,
(trg)="24"> f ) he shall be responsible for coordinating all the activities of other EL.S.S. agencies relating to the development , production and dissemination of the official statistics of Greece , as well as for the implementation of the national quality assurance framework for statistics ;

(src)="25"> ζ ) μπορεί να αποφασίζει τη διενέργεια κάθε είδους στατιστικών ερευνών , απογραφών και μελετών , επιπλέον αυτών που προβλέπονται στο ΕΛ.Σ.Π. και στο ετήσιο στατιστικό πρόγραμμα εργασίας της ΕΛ.ΣΤΑΤ.
(trg)="25"> g ) he may issue a decision ordering that all manner of statistical surveys , censuses and studies be carried out in addition to those specified in the Hellenic Statistical Programme ( EL.S.P. ) , and the EL.STAT. annual statistical work programme ;

(src)="26"> η ) εκπροσωπεί την ΕΛ.ΣΤΑΤ. δικαστικώς και εξωδίκως , ενώπιον των Δικαστηρίων , κάθε Αρχής και τρίτων .
(trg)="26"> h ) he shall represent EL.STAT. judicially and extra-judicially , before the courts , all authorities and third parties .

(src)="27"> Ο Πρόεδρος της ΕΛ.ΣΤΑΤ. μπορεί να αναθέσει την εκπροσώπησή της στο Νομικό Σύμβουλο της ΕΛ.ΣΤΑΤ. ή σε υπάλληλο της ΕΛ.ΣΤΑΤ. ,
(trg)="27"> The President of EL.STAT. may assign the task of representing the authority to the Legal Advisor of EL.STAT. or an employee of EL.STAT. ;

(src)="28"> θ ) προΐσταται των υπηρεσιών της ΕΛ.ΣΤΑΤ , συντονίζει και κατευθύνει τη λειτουργία τους , παρέχει τις υπηρεσιακές εντολές για την εκτέλεση κάθε ενέργειας που αφορά την εκπλήρωση της αποστολής της ΕΛ.ΣΤΑΤ. και συγκροτεί ομάδες εργασίας από το ειδικό επιστημονικό ή το λοιπό προσωπικό της ΕΛ.ΣΤΑΤ. ορίζοντας και το αντικείμενο τους ,
(trg)="28"> i ) he shall be the head of EL.STAT. ' s various units , coordinate and direct their operation , provide orders for various measures to be taken relating to the discharge of EL.STAT. ' s mission , and shall set up working groups comprised of specialist or other staff of EL.STAT. and shall specify their remit ;

(src)="29"> ι ) προΐσταται ιεραρχικά και πειθαρχικά του προσωπικού της ΕΛ.ΣΤΑΤ. και μεριμνά για τη συγκρότηση και τη λειτουργία του Υπηρεσιακού και του Πειθαρχικού Συμβουλίου , σύμφωνα με τις κείμενες διατάξεις ,
(trg)="29"> j ) he shall be the head , hierarchically and disciplinarily , of EL.STAT. ' s personnel , and assure that a Career Advancement Board and a Disciplinary Board are set up and run in accordance with the existing provisions ;

(src)="30"> ια ) καταρτίζει τους ετήσιους προϋπολογισμούς , απολογισμούς και ισολογισμούς της ΕΛ.ΣΤΑΤ. ,
(trg)="30"> k ) he shall prepare the EL.STAT. annual budgets , annual reports and balance sheets ;

(src)="31"> ιβ ) είναι αρμόδιος για κάθε θέμα που αφορά τη διοικητική λειτουργία και την οικονομική διαχείριση της ΕΛ.ΣΤΑΤ. και αναλαμβάνει ως διατάκτης των δαπανών της ΕΛ.ΣΤΑΤ. τις υποχρεώσεις σε βάρος των πιστώσεων του προϋπολογισμού της ,
(trg)="31"> l ) he shall be responsible for all matters relating to the administrative operations and financial management of EL.STAT. and as the person responsible for ordering the incurring of expenditure by EL.STAT. , he shall assume obligations , which entail the disbursement of its budget appropriations ;

(src)="32"> ιγ ) ανακατανέμει ανά κατηγορία , κλάδο και ειδικότητα τις κενές οργανικές θέσεις που προβλέπονται στον Οργανισμό της ΕΛ.ΣΤΑΤ. ,
(trg)="32"> m ) he shall reallocate to categories , branches and specializations , the vacant permanent ( organic ) positions that are provided for in the Organisation of ELSTAT ;

(src)="33"> ιδ ) δύναται να μεταβιβάζει αρμοδιότητες του σε άλλα όργανα της ΕΛ.ΣΤΑΤ. και να εξουσιοδοτεί με απόφασή του όργανα της ΕΛ.ΣΤΑΤ. να υπογράφουν « με εντολή Προέδρου » έγγραφα ή άλλες πράξεις της με αποφάσεις που δημοσιεύονται με ανάρτηση στο διαδικτυακό τόπο της ΕΛ.ΣΤΑΤ. χωρίς να απαιτείται άλλη δημοσίευση τους ,
(trg)="33"> n ) he may transfer competences to other officers of EL.STAT. and issue a decision authorising officers of EL.STAT. to sign documents or other decisions “ On the President 's Orders ” , by means of decisions published by posting them to EL.STAT. ' s website without requiring any other form of publication ;

(src)="34"> ιε ) ασκεί κάθε άλλη αρμοδιότητα της ΕΛ.ΣΤΑΤ. που προβλέπει ο νόμος και ο Κανονισμός Λειτουργίας και Διαχείρισης της ΕΛ.ΣΤΑΤ.
(trg)="34"> o ) he shall exercise all other powers of EL.STAT. laid down by law and by the Regulation on the Operation and Administration of EL.STAT.

(src)="35"> iv ) Ο Πρόεδρος της ΕΛ.ΣΤΑΤ. διορίζεται για πενταετή θητεία με απόφαση του Υπουργού Οικονομικών που δημοσιεύεται στην Εφημερίδα της Κυβερνήσεως .
(trg)="35"> iv ) The President of EL.STAT. is appointed for a five-year term of office by decision of the Minister of Finance which is published in the Government Gazette .

(src)="36"> Η θητεία του Προέδρου μπορεί να ανανεώνεται για μία μόνο φορά με απόφαση του Υπουργού Οικονομικών .
(trg)="36"> The President 's term of office can be renewed only once by decision of the Minister of Finance .

(src)="37"> v ) Οι πάσης φύσεως αποδοχές του Προέδρου της ΕΛ.ΣΤΑΤ. καθορίζονται με απόφαση του Υπουργού Οικονομικών .
(trg)="37"> v ) The remuneration of any kind of the President of EL.STAT. is defined by decision of the Minister of Finance .

(src)="38"> vi ) Ο Πρόεδρος της ΕΛ.ΣΤΑΤ. δύναται να παυθεί , με απόφαση του οργάνου που τον διόρισε , για αδυναμία άσκησης των καθηκόντων του λόγω κωλύματος , νόσου ή αναπηρίας ή για σπουδαίο λόγο που αφορά την εκτέλεση των καθηκόντων του , όπως ιδίως η αποκάλυψη εμπιστευτικών θεμάτων , για τα οποία έλαβε γνώση κατά την άσκηση των καθηκόντων του , ή η κατάχρηση της θέσης του για ίδιο , προσωπικό ή εμπορικό όφελος .
(trg)="38"> vi ) The President of EL.STAT. may be discharged by decision of the very administrative body which appointed him , for inability in the exercise of his duties due to impediment , illness , or disability , or for any serious grounds relating to the performance of his duties , such as the disclosure of confidential information , which he became aware when exercising his duties , or abuse of his position for personal or commercial profit .

(src)="43"> α ) η υψηλή επιστημονική κατάρτιση με επαγγελματική ή ακαδημαϊκή εξειδίκευση στο αντικείμενο της στατιστικής ή συναφών κλάδων ή σε αντικείμενο συναφές προς το αντικείμενο των στατιστικών ερευνών και μελετών και
(trg)="43"> ( a ) the high scientific training , with professional or academic expertise in the field of statistics or similar fields or in a field relevant to that of statistical surveys and studies , and

(src)="44"> β ) η ικανότητα του υποψηφίου , όπως προκύπτει από την επαγγελματική και επιστημονική του πορεία , να ανταποκριθεί στις απαιτήσεις των στατιστικών αρχών που προβλέπονται στο άρθρο 338 παρ . 2 ΣΛΕΕ , στο άρθρο 2 του Κανονισμού 223 / 2009 και στον Κώδικα Ορθής Πρακτικής για τις Ευρωπαϊκές Στατιστικές
(trg)="44"> ( b ) the candidate 's ability , as indicated by his professional and scientific career , to meet the requirements of the statistical principles provided for in article 338 paragraph 2 of the TFEU , in article 2 of Regulation ( EC ) No 223 / 2009 and in the European Statistics Code of Practice .

(src)="50"> α ) έχει καταδικαστεί για αδικήματα κατά της ιδιοκτησίας ή κατά περιουσιακών δικαιωμάτων ή για αδικήματα σχετικά με τα υπομνήματα ή σχετικά με την υπηρεσία ή για αδικήματα κατά των ηθών , καθώς και εάν έχει καταδικαστεί για οποιοδήποτε κακούργημα ( παρ . 4 του άρθρου 3 του ν . 3051 / 2002 ) ,

(src)="93"> Βάσει των στοιχείων που υποβάλλονται από τους υποψηφίους και κάθε άλλο σχετικό στοιχείο που συλλέγει , η Επιτροπή Εμπειρογνωμόνων εισηγείται αιτιολογημένα στον Υπουργό Οικονομικών την επιλογή του υποψηφίου που ανταποκρίνεται στο μέγιστο βαθμό στα νόμιμα κριτήρια επιλογής του Εδαφίου ΙΙΙ i ) ανωτέρω .
(trg)="91"> On the basis of the information submitted by the candidates and any other relevant information it has collected , the Committee of Experts makes a justified recommendation to the Finance Minister for the choice of the candidate who meets to the fullest extent the consistent-with-the law selection criteria referred to in paragraph III i ) above .

(src)="94"> Σε περίπτωση που ο Υπουργός Οικονομικών δε συμφωνεί με την εισήγηση της Επιτροπής , μπορεί να διορίσει ως Πρόεδρο της ΕΛ.ΣΤΑΤ. τον υποψήφιο που επιλέγει ο ίδιος , μετά από προηγούμενη κοινοποίηση στην Επιτροπή πλήρους αιτιολογίας της επιλογής του , σύμφωνα με τα προβλεπόμενα στο Εδάφιο ΙΙΙ i ) , ανωτέρω , αποκλειστικά κριτήρια επιλογής , και αφού η Επιτροπή του γνωστοποιήσει την κρίση της σχετικά με την ανταπόκριση του υποψηφίου στα κριτήρια επιλογής .
(trg)="92"> In the event that the Minister of Finance does not agree with the recommendation of the Committee , the Minister may appoint as President of EL.STAT. the candidate of his choice after prior notification to the Committee with the full justification of his choice of candidate in accordance with the exclusive selection criteria provided for in paragraph III i ) above , and after the Committee notifies the Minister of its judgment about this candidate 's meeting of the selection criteria .
